1. HOW IT WORKS: From July 24, 2008 through March 31, 2009, while supplies last, or until the prizes specified below are validly won (the "Sweepstakes Period"), agents of Sponsor at participating Sponsor locations shall distribute PINs to eligible participants who may then enter said PIN on the website specified below for a chance to win one of the prizes listed in paragraph 6 below.
2. ELIGIBILITY: Open to legal U.S. residents who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of Sponsor, its parents, affiliates and subsidiaries, participating advertising and promotion agencies and prize suppliers (and members of their immediate family and/or those living in the same of household of each) are not eligible.
3. HOW TO PLAY: During the Sweepstakes Period an eligible contestant may receive a PIN ("PIN") by staying at a participating Sponsor location. Upon check-in, the location manager will write a PIN on a tear-off sheet to be provided to said contestant. In the event a contestant stays at the participating Sponsor location for longer than one week, then said contestant may visit the front desk and receive one (1) additional PIN for each additional week he/she stays at said Sponsor location. Limit one (1) PIN per person per week, except as otherwise explicitly provided herein. The contestant may then visit Sponsor's sweepstakes website at www.ValuePlace.com/50KGiveawayand enter his/her required personal information and PIN as directed. The contestant will be prompted to enter the email address of the person who referred him/her to Sponsor's location, if applicable. Upon pressing "Submit", the contestant will instantly receive a "thank you" message and his/her entry will be entered into the sweepstakes drawing. At that time, the contestant may also enter the email addresses of individuals the contestant would like to refer to the sweepstakes, and an email will be sent to said individuals with a PIN and instructions on how to enter. In the event contestant refers another individual in the manner described above, and said individual enters the sweepstakes and confirms the referral pursuant to the instructions detailed in the email sent to the referred individual, then the contestant will be entitled to no more than ten (10) additional PINs for entry, and the individual who was referred by contestant shall be entitled to no more than five (5) entries. Each unique PIN is eligible for only one (1) entry and may not be entered more than one (1) time. At the conclusion of each month of the Sweepstakes Period, while supplies of PINs last, exactly five (5) entries and five alternate entries will be randomly selected from among all entries received in that month of the Sweepstakes Period. Those entries selected will be eligible to receive one of the secondary prizes specified in paragraph 6 below. On or about April 6, 2009, exactly one (1) entry and three (3) alternate entries will be randomly selected from among all entries received throughout the Sweepstakes Period excluding those entries which were selected as winners of secondary prizes specified in paragraph 5 below, and that entry will be eligible to receive the Grand Prize specified in paragraph 6 below. All potential winners are subject to verification of eligibility and compliance with the sweepstakes rules before any prize will be awarded. Notification will be sent by telephone to a selected winner within ten (10) days of the drawing at the telephone number provided at entry. Except where prohibited, potential winner must sign and return within ten (10) days of attempted notification, an affidavit of eligibility and liability/publicity release in order to claim his/her prize. If a potential winner cannot be contacted within ten (10) days of the first attempt to contact him/her or if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, one of the alternate entries selected in the drawing maybe selected as the potential winner in his/her place at random. If the alternate entries are exhausted and no potential winner is able or willing to comply with the requirements set forth herein, said prize may not be awarded. All taxes on any prize are the sole responsibility of the winner.
4. TO OBTAIN A PIN WITHOUT PURCHASE: During the Sweepstakes Period, an individual may obtain a free PIN by visiting a participating Sponsor location and requesting a PIN. He/she will be invited to take a voluntary tour of Sponsor's location, but is not required to do so in order to obtain a PIN. PINs will be available while supplies last or until the prizes specified in paragraph 6 are no longer available. Individuals may also visit www.ValuePlace.com/50KGiveawayand download the entry form provided, fill it out completely and legibly, and send it along with a self-addressed stamped envelope to Value Place Franchise Services, LLC, Attn: 50K Sweepstakes, 8621 E. 21st Street North, Suite 250, Wichita, KS 67206 in order to receive a free PIN. Vermont residents may omit return postage. Limit one entry request per outer mailing envelope, and limit four (4) PINs per person per month of the Sweepstakes Period. PINs must be entered online as described above by the last calendar day of a given month to be eligible for that month's drawing. To be eligible for the April 6th drawing, a PIN must be entered online no later than March 31, 2009. 5. CONDITIONS OF PARTICIPATION: If due to printing, production or other errors, more prizes are claimed than intended, the intended prize will be awarded in a random drawing from all those submitting purportedly valid claims. No more than the number of prizes set forth in these Official Rules will be awarded. PINs not legitimately obtained and/or used in accordance with these rules are void. Use of any automated system to participate is prohibited and will result in disqualification. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. A CONTESTANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL SAID CONTESTANT'S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND SAID CONTESTANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE ENTRY AND IS VOID AND WILL NOT BE HONORED. No transfer, assignment or substitution of a prize will be permitted, except Sponsor reserves the right to substitute prize for an item of equal or greater value in the event an advertised prize is unavailable. All federal, state and local laws and regulations apply. Contestants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this sweepstakes. Confirmation e-mails returned as undeliverable may result in disqualification. Acceptance of a prize constitutes permission for Sponsor and its agencies to use winner's name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting prize, winners agree to hold Sponsor, its respective directors, officers, employees, assigns, and advertising and promotional agencies harmless for any injury or damage caused or claimed to be caused by participation in the Promotion. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prize. Sponsor is not responsible for lost or stolen PINs.
6. PRIZES AND APPROXIMATE RETAIL VALUES: One (1) and only one Grand Prize of $50,000 is available to be won. Odds of winning the Grand Prize are 1:10,000,000. For each month of the Sweepstakes Period for a maximum of eight (8) months, or while supplies of PINs last, five (5) secondary prizes of $1,000 will be available to be won (for a total not to exceed forty (40) secondary prizes). Odds of winning a $1,000 secondary prize are dependent upon the total number of entries received. All prizes will be paid in the form of a check, which shall be sent to the verified winner via certified U.S. mail within five business days of verification of the win and winner's eligibility. One secondary prize, per person, per household. Unclaimed prizes will not be awarded.
7. INDEMNIFICATION. By participating, contestants agree to release, discharge, indemnify and hold harmless Sponsor, its respective officers, directors, employees, representatives, agents, advertising and promotional agencies from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any sweepstakes-related activity or participation in this sweepstakes.
8. INTERNET: In the event of a dispute as to any registration or play, the authorized account holder of the email account used to log in to the sweepstakes website will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email account by a service provider or other entity responsible for assigning email accounts for the service. Potential winners may be required to show proof of being the authorized account holder. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes, technological or otherwise, which corrupt, disrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend any and all aspects of the sweepstakes. Sponsor reserves the right, but not the obligation, to randomly select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by any individual to deliberately damage any Web site or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent of the law.
9. GOVERNING LAW; DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the 18 Judicial District of Kansas or the appropriate Kansas State Court located in Sedgwick County, Kansas; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will a participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the State of [STATE], without regard to conflicts of law rules.
10. WINNER'S LIST: For the names of winners, if any, send a separate self-addressed, stamped envelope to: "$50,000 Refer-A-Stay Giveaway Sweepstakes Winners List," 8300 Douglas Ave Ste 623, Dallas, TX 75225. Requests must be received by May 31, 2009.
